GTC

OBJECT
The present general conditions govern the services offered by aliceboat, i.e. guided boat tours, in the Alpes-Maritimes department.
They apply to all participants in the guided tours offered.


COSTS INCLUDED
The amount of the service includes rental, fuel, cleaning, food, drinks, and masks, snorkels.


OUT OF CHARGE

The amount of the service does not include all the expenses which are not mentioned under the above list "included expenses".


PAYMENTS AND CANCELLATION
If the client cancels the tour, any deposit or payment will be refunded according to the day and reason of the cancellation, by the following conditions:

- 30 days before the visit: 25% of the total amount will be charged to the client.
- 15 days before the visit: 50% of the total amount will be charged to the client.
- 7 days before the visit: No refund.
- Impassable sea, bad weather and unforeseen events like restrictions
COVID restrictions : full refund

If the boat is unseaworthy due to an accident, breakdown, or other circumstances, the contract is cancelled: full refund.

If aliceBoat cancels the visit: full refund.


FORCE MAJEURE
Force Majeure is defined as a cause attributed to acts of God, accidents, natural disasters, weather conditions or other events beyond the reasonable control of aliceboat or the client, and not caused by aliceboat or by the negligence of the client.
Aliceboat reserves, in addition, the possibility to interrupt a tour in case of force majeure without giving rise to any refund.

No guarantee is made as to the suitability of weather conditions for this service. However, should a storm threaten or be expected to threaten, aliceboat will cancel the tour due to weather and provide a coupon to be used on another date.

If this is not possible for the customer, compensation may be paid.


POWERS
Aliceboat reserves the right to modify the planned itineraries according to the weather conditions. The skipper alone decides and adapts the pace of the tour and the breaks.
The skipper meets all the requirements necessary to legally operate the yacht in the chartered area. It is understood that the skipper is in full command, and that the client agrees to abide by his judgment on the itinerary, weather conditions, anchorages and other relevant matters.


RESPONSIBILITY AND INSURANCE
The Client agrees to carry out the guided tour and to use the equipment loaned in accordance with the safety instructions presented by the skipper and the Maritime Code.


Alice Bougault will not be held responsible for any physical or material damage caused by the use of the equipment that does not comply with the safety instructions or the Maritime Code.
The Customer certifies that he/she has taken out civil liability insurance covering the leisure activity for any damage that may be caused to third parties during the guided boat tour.

Alice Bougault certifies that she has taken out civil liability insurance covering her own activities.

Alice Bouagult, undertakes to keep the boat fully insured against fire, collision risks and to have third party liability coverage for the duration of the tour.


Alice Bougault shall not be liable for any loss or damage to personal property or for any injury suffered by the client, or his or her guests during the tour, regardless of whether such loss or injury occurred on the boat or elsewhere. Specifically, but without limiting the foregoing, Alice Bouagult and its insurers do not accept any liability for accidents, injuries or death related to the swimming and/or use of snorkels, masks or related equipment provided by aliceboat.

The customer is required to return the equipment in good working order and clean. In the event of damage or loss of any of the accessories listed in the inventory, the customer is obliged to pay for their repair or replacement with identical ones.


PARTICIPATION IN A BOAT TOUR
Guided tours are accessible to adults and minors hired by their legal representative. The client declares that he/she is fit to sail and has no medical contraindications. The client declares that he/she knows how to swim for all activities at sea.


ACCIDENTS

Aliceboat agrees that if the boat, during the guided tour, is out of order, damaged by fire, or collision and unusable by the client for a period of twenty-four consecutive hours or more, and none of these conditions is caused by any act of the client, the client shall have the right to cancel the guided tour.
Aliceboat will refund in full the sums paid by the client, as mentioned in the previous point


"PAYMENTS AND CANCELLATION".

The customer also agrees to be responsible for and to replace, repair or reimburse all damages to the boat, its equipment and furniture, caused by himself or by any of his guests.


CONFLICT OF JURISDICTION AND APPLICABLE LAW
In the event of a dispute arising from the interpretation or execution of the service contract or its related general terms and conditions of sale, French law will apply and the court of Nice will have jurisdiction. In addition, if the present conditions are translated into other languages, the French version will be the reference in case of dispute.


PROTECTION OF PERSONAL DATA
In accordance with the law "informatique et libertés" of January 6, 1978 modified in 2004, the customer has a right of access and rectification to the data which concern him. He must then contact Alice Bougault by mail at the following address:

The customer may also, for legitimate reasons, oppose the processing of data concerning him.
